The very act of creating an original “work” brings copyright protection into existence and affords the creator of the original work protection against an unauthorized third party from copying such work. We assist authors, composers, screenwriters, computer programmers, visual artists, recording artists, celebrated personalities and other creators in protecting and enforcing their rights. Whether it is negotiating and drafting agreements detailing the rights of our clients, or prosecuting a legal claim against copyright infringers of our clients’ creative works, we effectively assist our clients in all matters of copyright.
 
Trade Marks
 
A trade mark tells the public that products and/or services with that name or mark come from a particular source with certain attributes that the owner of the name or mark wants associated with such products and/or services. Registration under the Trade Marks Act affords a trade mark registrant the benefit of very strong evidence (called  prima facie evidence) that such registrant is the rightful owner of the name or mark. Anyone other than the trade mark registrant that uses the trade mark on a product or service that is competitive with those of the trade mark registrant will have the onus of proving that the name or trade mark is not associated in the mind of the public with the products or services of the trade mark registrant.
 
We will assist with the registration of the trade mark and advise in all matters relating to trade mark protection and enforcement.
